This website and mobile app (collectively, the “Site”) and the materials within it are © 2016 – 2025 The Home Depot. Viewing or using this Site creates a copy of The Home Depot materials in your device's random access memory and/or in your hard drive and/or in your proxy server. All Rights Reserved. For the purposes of these Terms of Use, The Home Depot shall include its affiliates, including Home Depot International, Inc. and Home Depot of Canada Inc.
We grant you permission to view and use this Site and to print individual pages from this Site for your own personal, non-commercial use, provided that you agree to and accept without modification the terms and conditions and notices in these terms of use (collectively, this “Agreement”). You may not modify, copy (except as set forth in the preceding sentence), distribute, transmit, display, perform, reproduce, publish, license, screen scrape (and any other activity intended to collect, store, reorganize or manipulate data on the pages produced by, or displayed on the Site), create derivative works from, transfer or sell any information, material, software, products or services from this Site.
The trademarks, service marks and logos (collectively, the "Trademarks") used and displayed on this Site are registered and unregistered Trademarks of The Home Depot. Nothing on this Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on this Site without the prior written permission of the Trademark owner. The Home Depot aggressively enforces its intellectual property rights to the fullest extent of the law. The Home Depot’s name, logo, or other The Home Depot formatives may not be used in any way, including in advertising or publicity pertaining to distribution of materials on this Site, without prior, written permission from The Home Depot. The Home Depot prohibits use of our logo as part of a link to or from any external website unless establishment of such a link is approved in advance by The Home Depot in writing. Fair use of The Home Depot’s Trademarks requires proper acknowledgment. Other product and company names mentioned in this Site may be the Trademarks of their respective owners.
2. Use of This Site
Your use of this Site constitutes your agreement and acceptance without modification of the notices, terms and conditions set forth herein. As a condition of your use of this Site, you represent and warrant to The Home Depot that you will not use this Site for any purpose that is unlawful, immoral or prohibited by these terms, conditions and notices, including without limitation:
- Misrepresenting the identity of a user, impersonating any person or entity, falsely stating or otherwise misrepresenting your affiliation with any person or entity in connection with this Site, or expressing or implying that we endorse any statement you make.
- Using this Site in any manner that constitutes fraud or any other violation of any applicable law, statute, ordinance or regulation (collectively, “Laws”).
- Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure.
- Acting as a reseller, which is defined as a user which purchases products with the intention of selling them rather than using them. Reseller activities include, but are not limited to: (i) purchasing products for the purpose of reselling those products through other channels to downstream customers; (ii) placing orders on behalf of other persons for commercial purposes; and/or (iii) extracting, scraping, mining, copying or otherwise gathering information from this Site in connection with your sale or another party’s sale of products (whether purchased from us or another seller) through any channel to downstream customers. Purchasing a product that will be used or consumed as part of a home improvement or construction project performed for another person does not constitute a reseller activity. We reserve the right to prohibit purchases of products to resellers and/or to reject a tax-exempt application from resellers.
If you do not agree and accept without modification this Agreement, do not use this Site. Other than this Agreement and agreements between you and The Home Depot relating to the sale of products or services to you through this Site, The Home Depot will not enter into any agreement with you or obligation to you through this Site and no attempt to create such an agreement or obligation will be effective.
3. Product Orders
a. General. By placing an order, you agree to pay all charges incurred by you and any users of your account and your credit card (or other applicable payment mechanism) at the price(s) in effect when such charges are incurred. By placing an order, you represent that you have complied with this Agreement and the products ordered will be used in a lawful manner. If we believe that your conduct or purchasing activity violates Laws or this Agreement, we reserve the right, in our sole discretion, with or without prior notice, to: (i) limit the available quantity of or discontinue any product or service; (ii) impose conditions on honouring any promotional coupon, coupon code, promotional code, or similar promotion or discount (collectively, a “Coupon”); (iii) bar any user from making or completing any or all transaction(s); (iv) refuse to provide any user with any product or service; (v) modify or cancel any offer; and/or (vi) terminate or suspend your account.
b. Availability. While we will use our best efforts to fulfill all orders, The Home Depot cannot guarantee the availability of any particular product displayed on this Site. The Home Depot reserves the right to discontinue the sale of any product listed on this Site at any time without notice.
c. Quantities. We reserve the right to limit quantities on orders placed: (i) by the same person or entity (including by third parties acting under the control or direction of a person or entity, or by automated processes controlled or directed by a person or entity); or (ii) using the same account, method of payment, or billing and/or shipping address. We will notify you if such limits are applied.
d. Prices and Errors. Product prices offered on this Site may vary from other advertised prices due to varying conditions in different geographic markets. The prices displayed on this Site are quoted in Canadian dollars and are valid and effective only within Canada, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for the payment of any shipping and handling charges and any applicable taxes that may apply to your order. While our goal is a 100% error-free Site, we do not guarantee that any content is accurate or complete, including price information and product specifications. If we discover price errors, they will be corrected on our systems, and the corrected price will apply to your order. The Home Depot reserves the right to revoke any stated offer and correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted), and cancel outstanding orders. We may also provide AI powered features to provide a better online shopping experience for our customers. We aim to have these features be as accurate as possible; however, always read labels, warnings, and directions and other information provided with a product before using a product. e. Coupons. Unless otherwise noted on a Coupon, Coupons issued by The Home Depot: (i) may not be combined with other Coupons or promotions or used on prior purchases; (ii) are void if sold or transferred; and (iii) may not be applied to merchandise on sale or clearance, special order items, tool rental fees, labor items, gift cards, services (including freight and delivery), or, in some cases, major appliances or commodity products (including lumber, wire, and building materials). f. Notice to Credit and Debit Card Users: By submitting your order ( i ) an authorization for your transaction will be placed and maintained on the credit or debit card you provided to Home Depot (“Card”) and upon completion of your transaction, the total transaction amount will be settled against the authorization in accordance with your banking institution’s policies, and (ii) you authorize Home Depot to charge the Card all amounts owed under the transaction, including deposits. You further authorize Home Depot to re-initiate any charge on your Card that is dishonoured for any reason.
g. Other. Certain products may be the subject of third-party warranties offered by its manufacturers or providers. Warranty information regarding products is available to you by calling 1-800-628-0525 or available on the Site, as applicable. Additional terms and conditions applicable to your online purchases are provided to you on the Site as you order products, prior to completing your purchase.

7. Uploaded Content
By submitting any content to The Home Depot (including photos and/or videos), via this Site or otherwise, you represent and warrant that: (i) you are the sole author and owner of the intellectual property rights thereto; (ii) all "moral rights" that you may have in such content have been voluntarily waived by you; and (iii) use of the content you supply does not violate this Agreement and will not cause injury to any person or entity.
You further agree and warrant that you shall not submit any content: (i) that is known by you to be false, inaccurate or misleading; (ii) that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (iii) that violates Laws (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (iv) that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation; (v) for which you were compensated or granted any consideration by any third party; or (vi) that contains any computer viruses, worms or other potentially damaging computer programs or files.
You agree to indemnify and hold The Home Depot (and its officers, directors, agents, joint ventures, employees and third-party service providers), harmless from all claims, demands, and damages of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of your breach of this Agreement, or your violation of Laws or the rights of a third party.
For any content that you submit, you grant The Home Depot and its authorized third-party service providers a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from, sell and/or distribute such content, incorporate such content into any form, medium or technology, or use such content as training data for AI features or tools, throughout the world without compensation to you.
All content (including photos and/or videos and all data contained or appended thereto) that you submit may be used and shared with authorized third-parties at The Home Depot's sole discretion. The Home Depot reserves the right to change, condense or delete any content on this Site that The Home Depot deems, in its sole discretion, to violate this Agreement. The Home Depot does not guarantee that you will have any recourse through The Home Depot to edit or delete any content you have submitted. You acknowledge that you, not The Home Depot, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of The Home Depot, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees.
8. Disputes and Governing Law
IF YOU ARE A RESIDENT OR HAVE PURCHASED A PRODUCT FOR PERSONAL USE IN ANY PROVINCE (SUCH AS THE PROVINCE OF QUEBEC), TERRITORY OR JURISDICTION WHERE SUCH CLAUSES OR WAIVERS ARE PROHIBITED, THEN THIS SECTION 9 DOES NOT APPLY TO YOU FOR ANY CLAIMS WHICH ARE GOVERNED BY LAWS APPLICABLE TO YOU.
You agree that this Agreement and your use of this Site are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to its conflict of laws provisions. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organisations in Toronto, Ontario, Canada for all disputes (a) arising out of, relating to, or concerning this Site and/or this Agreement, (b) in which this Site and/or this Agreement is an issue or a material fact, or (c) in which this Site and/or this Agreement is referenced in a paper filed in a court, tribunal, agency, or other dispute resolution organization.
ARBITRATION.
THIS SECTION DOES NOT AND IS NOT INTENDED TO WAIVE ANY RIGHTS YOU MAY HAVE UNDER ANY PROVINCIAL OR TERRITORIAL LAWS APPLICABLE TO YOU WHICH PROHIBIT AGREEMENTS TO ARBITRATE, CLASS ACTION AND JURY TRIAL WAIVERS.
With the prior agreement of Home Depot, any claim, dispute or controversy arising out of, relating to or concerning this Site and/or this Agreement shall be decided by binding arbitration in accordance with the Arbitration Act, 1991 and any such arbitration proceedings shall be brought and held in Toronto, Ontario. The decisions of the arbitrators shall be binding and conclusive upon all parties involved and judgement upon any award of the arbitrators may be entered by any court having competent jurisdiction. This provision shall be specifically enforceable in any court of competent jurisdiction.
9. Other Terms
This Site is made available to residents of Canada only. Use of this Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this Agreement, including without limitation this paragraph and the warranty disclaimers and liability exclusions above. The Home Depot has endeavored to comply with all legal requirements known to it in creating and maintaining this Site, but it makes no representation that materials on this Site are appropriate or available for use in any particular jurisdiction. Use of this Site is unauthorized in any jurisdiction where all or any portion of this Site may violate any legal requirements, and you agree not to access this Site in any such jurisdiction. You are responsible for compliance with Laws. Any use in contravention of this provision or any provision of this Agreement is at your own risk and, if any part of this Agreement is invalid or unenforceable under Laws, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of this Agreement shall govern such use.
You agree that The Home Depot may at any time and without notice change this Agreement; however, any changes after your last usage of this Site will not be applied retroactively. Your continued use of the Site after any such change constitutes your acceptance of the revised Terms of Use.
You agree that no joint venture, partnership, employment or agency relationship exists between you and The Home Depot as a result of this Agreement or your use of this Site.
The Home Depot's performance of this Agreement is subject to Laws and legal process, and nothing contained in this Agreement is in derogation of The Home Depot's right to comply with law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by The Home Depot with respect to such use.
This Agreement, the Privacy & Security Statement, and other terms on the Site constitute the entire agreement between you and The Home Depot with respect to this Site. This Agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and The Home Depot with respect to this Site. No modification of this Agreement shall be effective unless it is authored by The Home Depot, or unless it is physically signed in blue ink by a The Home Depot officer. Any alleged waiver of any breach of this Agreement shall not be deemed to be a waiver of any future breach. A printed version of this Agreement and/or of any notice given by The Home Depot in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement or your use of this Site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by The Home Depot in printed form.
